TP/1317/2024 (E-filing) WITH WILL/465/2024 Mr. Sudhir Yadav, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. In this petition, order for General Citation was issued on 22.04.2024. Affidavit of Service of General Citation was filed on 25.06.2024. Ld. Advocate for petitioner submits that in the present petition, they have taken out Chamber Order No. 496 of 2024 to serve the legal heirs of deceased by way of paper publication since they do not have details of legal heirs of deceased. The said Chamber Order was allowed as per the order passed by the Additional Prothonotary and Senior Master / Additional Registrar (O.S.), Bombay High Court and citation dated 13.11.2024 was published in the "Free Press Journal" in English language on 25.11.2024 and in "Jam-E Jamshed" in Gujarati language on 24.11.2024, widely circulated in Mumbai. Accordingly, Affidavit of Service of publication of citation dated 02.12.2024 is filed. Ld. Advocate for petitioner further submits that no Caveat or objection is filed in the present petition till date.

2. Ld. Advocate for petitioner submits that they have to file an Affidavit stating that the petitioner was not aware about the details of legal heirs hence, he requested to proceed in the matter.

3. I have perused the petition as well as submission made by the Advocate for petitioner. To decide this issue, Advocate to satisfy whether legal heirs of deceased not known to the Executor.

4. List the matter on 10.02.2025.
