Heard the learned Counsel for the Petitioner. 2.

The Department has raised an objection to the tenability of the Petition at the instance of the Petitioner who is the sister of the deceased, as the mother of the deceased, being Class I heir, is alive. 3.

Learned Counsel for the Petitioner submits that the mother of the deceased, who is 88 years of age, has given her consent for the grant of Letters of Administration. Her affidavit is annexed at page 17 of the Petition. 4.

In view of the averments in the said affidavit and the fact that the mother is 88 years of age, the office objection stands dispensed with. 5.

Department to proceed with the Petition.
