TP/1470/2024 (E-filing) Mr. Yunus Memon, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament alongwith Codicil of deceased filed by petitioner namely Sunil Ramesh Patel being sole Executor named under the Will of deceased. The deceased namely Sudhir Ramesh Patel died at Mumbai on 10.06.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 17.04.2022 and Codicil was duly executed at Mumbai on 27.05.2022, The said Will as well as Codicil are in English language. The Para No. 9 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will.

3. Ld. Advocate for petitioner submits that mother of deceased died on 12.10.2022. Deceased was survived by widow, three sons and two daughters. Out of them one son is petitioner herein and all other legal heirs have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavits of Sunil Ramesh Patel dated 12.07.2023 and Sanjay Ramesh Patel dated 06.04.2023 both the Attesting Witnesses to the Will are filed. Affidavits of Sunil Ramesh Patel dated 12.07.2023 one the Attesting Witnesses to the Will is filed. Affidavit of Service of General Citation dated 10.07.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
