TP/1509/2025 (E-filing) Mr. Farhad Vakil i/b. Mulla and Mulla Craigie Blunt and Caroe, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Bommy Farrokh Lashkari, Aspi Rusi Dordy, Fali Dosabhoy Avari and Porus Noshir Mobedjina being Executors named under the Will of deceased. The deceased namely Perviz Bommy Lashkari died at Mumbai on 17.09.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 28.06.2021. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executors. Only four Executors appointed under the Will. Para No. 1 of the Will refers to as one executor namely Bommy Farrokh Lashkari. The said para further states that if husband of deceased predeceased the deceased in that event the other three persons mentioned therein will act as an Executors. Since Mr. Bommy is alive and he is petitioner herein, the other three persons cannot be joined as petitioners herein. Hence, Advocate to take instructions and steps accordingly.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by her husband who is petitioner herein. Deceased died issue-less. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Hilla Adi Bhesania dated 17.12.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 08.07.2025 is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant. Hence, remove from board. 15.07.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
