1. Perused Petition which is filed on-line. Heard Ld. Advocate for Petitioners. This Petition is for Probate of Last Will and Testament of the deceased filed by Petitioners Farzana Kunal Thakore and Kunal Shobhan Thakore being the Executrix / Executor named under the Will of the deceased. Deceased Nadir Jal Muncherjee alias Bubbly, said to have died at Mumbai on 18.08.2023. Copy of Death Certificate is annexed to the Petition. Identification proof of the deceased viz. Copy of Adhaar Card is annexed to the Petition.

2. Mr. Sidhaarth Desai, Advocate for Petitioners submits that deceased left behind him last Will and Testament which was duly executed at Mumbai on 12.08.2021. The said Will is in English language.

3. Mr. Sidhaarth Desai, Advocate for Petitioners submits that deceased was governed under the Indian Succession Act 1925 applicable to Parsis. It is submitted that the Parents of the Deceased predeceased the deceased abovenamed. The deceased died as a widower. The Deceased left no son. Save and except as mentioned in para -9, there are no other legal heirs left by the deceased.

4. Petitioner's Oath is filed. The other executor Shazeen Norman vanHaaren, has filed her Affidavit dated 11.01.2024 reserving her rights as executrix. Consent Affidavit of married daughter of the ....2
