TP/1642/2024 (E-filing) Ms. Seema Hunnurkar, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Dr. Tanay Vasant Joshi and Manoj Arvind Purohit both being Executors named under the Will of deceased. Deceased namely Satish Vivek Joshi said to have died at Mumbai on 07.04.2021. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind his last Will and Testament which was duly executed at Mumbai on 03.02.2019. The said Will is in English language.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Wife of deceased expired on 21.07.2023. Deceased had only daughter namely Chandana Satish Joshi predeceased the deceased who died as spinster. Deceased had three brothers and two sisters. One brother of deceased namely Shashimohan Vivek Joshi died on 11.06.2003 and his wife died on 14.12.2001. Another brother of deceased namely Jagdish Vivek Joshi died on 09.07.2019, leaving behind his wife, two sons and he had no daughter. Another brother of deceased namely Vasant Vivek Joshi died on 08.12.2016 and his wife also died on 23.08.1986. One sister of deceased namely Suhasini Narendra Javle died on 26.08.2023 and her husband died on 27.11.2000, leaving behind two daughters. Another sister of deceased namely Shobhana Majajani died in the year 2018 leaving behind two daughters. Deceased was survived by five nephews and four nieces. Out of them one nephew is petitioner No. 1 herein and remaining legal heirs have given their consents. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Rewati Manoj Purohit dated 27.12.2023 one of the Attesting Witness to the Will is filed. Affidavit of Service of Publication of citation dated 12.12.2024 is filed in respect of the legal heirs whose whereabouts are not known. ......2

SLG - 2 - Affidavit of Service of General Citation dated 21.05.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
