Heard the learned Counsel for the petitioner. 2.

The petition is filed for Probate of the Last Will and Testament dated 15th March, 1993 of Homai Dinshaw Seervai. Two attesting witnesses namely; D. R. Gandhi and Pravinchandra Parekh have purportedly attested the signature of the deceased on Will.

The petitioner asserts that the petitioner is not aware as to who D. R. Gandhi is. The wife of Pravichandra Parekh, the other witness, has filed an affidavit to the effect that the signature appearing on the Will is that of her husband and the numerals 15/03/1993 are in his handwriting. Chandrika Pravinchandra Parekh has further affirmed that her husband knew the 1/2

24-TP1654-2024+.DOC deceased as both were working in the same office for many years.

In view of the averments in the affidavit of Chandrika Parekh, the affidavit of Chandrika Parekh be accepted in proof of the signature of attesting witness Pravinchandra Parekh. [N. J. JAMADAR, J.] 2/2
