The petitioner is the executor under the Will. It is stated that the Will is not available with the petitioner and therefore he has filed the Copy of the Will.

However, vide sec. 237 of the Indian Succession Act, 1925, the petitioner could have filed the petition for grant of the probate, until production of original Will.

Hence, the petitioner to ensure that the petition, in present form, is maintainable.
