Ld. Advocate for the petitioner to ensure that the legal heirs of the deceased as per Sec. 15(1)(d) read with Rule-3 of the Sec. 16 and Sec. 8 of the Hindu Succession Act, 1956. Though, father of the deceased died long bank, as per the Rule 3 of Sec. 16 of the HS Act, it has to be presumed that father died after the death of Pushpa. Hence, in such circumstances, the petitioners to ascertain that only class-I legal heirs are joined to the petition. 3.
