Heard Mr. Wani, learned Advocate for Petitioner. 2.

Present Testamentary Petition is filed by Petitioner for issuance of Letters of Administration under Section 278 of the Indian Succession Act, 1925 in respect of the properties and credits of deceased Gulam Mahdi Mehdi @ Gulam Mahdi Mohammed Qasim Syed. The names and details of legal heirs of the deceased are stated in paragraph No.4 of the Petition. Purpose for filing the present Petition is stated in paragraph Nos.8 and 9 of the Petition. I have perused the same.

Consent affidavits dated 16.12.2024, 10.12.2024, 06.12.2024 and 10.12.2024 of Qasim Mahdi Ghulam Mahdi Syed, Syed Sohail Ghulam Mahdi, Abid Mahdi Ghulam Sayed and Syed

P18.TP.1740.2025.doc Mehdi Raza Gulam Mehdi, the legal heirs of the deceased are appended to page No. 15,18,21 and 24 of the Petition. 4.

In view of the above, there can be no impediment in allowing the Petition. Testamentary Petition is allowed and disposed of in terms of un-numbered prayer clause which reads thus:- "That letters of Administration may be granted to the Petitioner as the Legal Heir having effect throughout in the State of Maharashtra."

Department is directed to issue the Letters of Administration as directed above within a period of 3 weeks from today positively. 6.

Testamentary Petition is allowed and disposed subject to compliance of office objections, if any, forthwith which shall be allowed by the Department.
