TP/1748/2024 (E-filing) Mr. Dudhane Saiprasad Rajendra, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Amod Ashok Bhandare being one of the Executors named under the Will of deceased. The deceased namely Ashok Madhukar Bhandare died at Mumbai on 12.10.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copies of Aadhaar Card and Pancard are annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 16.10.2003. The said Will is in English language.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased was survived by one son and one married daughter. Out of them son is petitioner herein and married daughter has filed her Affidavit for renouncing her rights as an Executor dated 05.03.2024. She also given her consent in favour of the petitioner. Consent Affidavit is on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Neela A Mahto dated 27.01.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 10.05.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
