TP/1837/2024 (E-filing) WITH WILL/674/2024 Mr. Ankit Yadav i/b. Mr. Dharmendra Damani, Advocate for petitioner. PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Jitendra Gangakrishna Damani, being Executor named under the Will of deceased. The deceased namely Harshada Labshanker Joshi, died at Mumbai on 26.04.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 18.10.2022. The said Will is in English language. The Para No. 8 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will. Residuary clause in respect of properties of deceased is mentioned at para No. 2 and 3 of the Will.

3. Ld. Advocate for petitioner submits that deceased died as spinster. Deceased had two sisters. Out of them one sister of deceased namely Vidula L. Joshi died issue-less. Another sister of deceased namely Taruna Pandya has given her consent in favour of petitioner herein. Consent Affidavit is filed separately through e-filing. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Taruna Harshad Pandya dated 20.12.2023 one of the Attesting Witness to the Will is filed and Affidavit of Hitendra Narsinh Paurana dated 20.12.2023 one of the Attesting Witness to the Will is also filed. Ld. Advocate for petitioner submits that Affidavit of Service of General Citation is filed on 12.12.2024 however, the uploaded Affidavit is of TP No. 3999 of 2024. Hence, Advocate to take steps accordingly.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant. Hence, remove from board. 18.12.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
