This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Tejas Suma Shyam being sole Executor named under the Will of deceased. The deceased namely Dhananjay Subbarao died at Mumbai on 14.08.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 27.06.2021. The said Will is in English language. The Para No. 3 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will. Petitioner is one of the executors and another executor namely Cassem Rajabali has renounced his rights to act as an Executor and Affidavit dated 06.06.2023 is filed to that effect.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. First wife of deceased divorced in the year 1989. Details of issues from the first wife is not mentioned in the petition hence, Advocate to take steps. Second wife was divorced in the year 2005. Deceased had no issue from the second wife.

4. Petitioner's oath is filed. Affidavit of Abu Baker Abbas Mansuri and Prasad Sankhe dated 09.06.2023 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant.
