TP/1951/2025 (E-filing) Mr. Rahul P. Jain, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain debts and securities belonging to deceased filed by petitioners namely Darius Burjor Shroff and Cyrus Burjor Shroff being grandsons of sister of the deceased. The deceased namely Jehangir Kaikhushroo Gora died intestate at Darjeeling, West Bengal on 26.01.1996. The filing of original death certificate is dispensed with by an order passed by this Hon'ble Court dated 07.04.2025. Petitioners has filed Affidavit dated 18.12.2024 for dispensation of identification proof of deceased. The same is accepted.

2. Ld. Advocate for petitioner submits that deceased died as bachelor. Parents of deceased predeceased the deceased. Deceased had three sisters and one brother who all have died and they are survived by legal heirs mentioned in para No. 4 of the petition. Deceased was survived by one niece, six granddaughters, nine grandsons and one daughter-in-law. Out of them two grandsons are petitioners herein and all the legal heirs have given their consents in favour of petitioner. Consent Affidavits are on record. There are no other legal heirs.

3. Ld. Advocate for petitioner points out that there was TP No. 4407 of 2023 was filed for Succession Certificate for the debts and securities of deceased namely Jehangir Kaikhushroo Gora by one Jaideep Singh Grewal and the grant for Succession Certificate was issued on 15.04.2024. The grant was challenged in the Misc. Petition No. 507 of 2024 by the legal heirs of deceased and the said Misc. Petition was disposed by filing the consent terms as per order dated 07.04.2025. By the said order the grant of Succession Certificate issued in favour of Jaideep Singh Grewal has been revoked.

4. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 16.06.2025 and Administration Bond dated 10.06.2025 are filed. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted. .......2
