TP/1960/2025 (E-filing) Ms. Shushma Bhende i/b. Patrawala & Co., Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Lakshminarayan Krishnan being sole surviving Executor named under the Will of deceased. The deceased namely Jairaj Manilal Negandhi died at Mumbai on 24.05.2020. Copy of death certificate is annexed to the petition. Identification proof of deceased i.e. copy of Aaddhar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 21.04.2010. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executors. Only two Executor appointed under the Will. Para No. 5 of the petition states that one executor executor namely Ravindra H. Dave died on 01.06.2014 hence, petitioner is sole surviving executor under the Will.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased died issue-less. Deceased had two brothers and had no sister. One brother of deceased namely Nerottam Negandhi predeceased the deceased. As per para Nos. 8 and 9 of the petition, deceased was survived by one nephew and two nieces who all have given their consents in favour of the petitioner herein. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Mitesh Ved dated 13.02.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 20.06.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
