TP/1996/2024 (E-filing) Ms. Surbhi Soni i/b. MGV and Associates, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of Notarized true copy of last Will and Testament of deceased filed by petitioner namely Sunita Lokesh Shah being sole Executrix named under the Will of deceased. Deceased namely Lokesh Hiralal Shah said to have died at Mumbai on 04.07.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind his last Will and Testament which was duly executed at Mumbai on 27.04.2023. The said Will is in English language.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by widow, one son and one daughter. Out of them widow is petitioner herein. Son and daughter have been served through Deputy Sheriff from the office of Sheriff, Mumbai and Affidavit to that effect is filed on 17.02.2025. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Ramdas Mahadik s/o. Shantaram Mahadik dated 16.12.2023 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation as well as Affidavit of Service of citation upon legal heirs dated 07.02.2025 through the Deputy Sheriff from the office of Sheriff, Mumbai is filed to that effect. All other legal formalities are complied with. Hence, petition is granted.
