TP/2011/2024 (E-filing) WITH WILL/786/2024 Mr. Chintan Shah, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Rajesh Jivanlal Rawal, Kishori Pramod Kapadia and Ashish Madhav Redij being Executors named under the Will of deceased. The deceased namely Pramilaben Bhupendra Dekhtawala died at Mumbai on 07.03.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 08.12.2017. The said Will is in Gujarati language and official translation of the office of Chief Translator, High Court, Bombay is filed through e-filing separately on the official portal of the Bombay High Court. The 2nd para of the Will refers to the appointment of Executors. Only three Executors appointed under the Will who all are petitioners herein. The properties mentioned in Schedule I annexed to the petition are referred in the Will.

3. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. Deceased died issue-less. Husband of deceased had three brothers. Two brothers of husband of deceased namely Pramod and Jitendra predeceased the deceased. Deceased was survived by one brother-in-law who has been served the citation with the newspaper publication and Affidavit of Service of Publication dated 16.12.2025 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Govind Rasiklal Shah dated 23.01.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 06.05.2025 is filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
