The petitioner submits that the all requisitions vide chapter XXVI has been complied with. Hence, the petitioner was taken for the order. However, it appears that the petitioner has taken a stand that he Vijay, a son of the deceased, is missing and therefore his heirs are brought on the record. However, the there is no order of the Hon'ble Court regarding the acceptance of this fact as per the provision of the Bhartiya Nyaya Sahita, 2023 or Civil death, etc. hence, the petitioner to take steps to prove this fact or take steps to serve the citation to this heir, by following due procedure, laid down, in this regard.
