Shri. Rajkumar Mishra i/b Shakti Ld. Advocate for the [Original] (ECHCBM020207220 Petitioner 24) with WILL/852/2024 1.

Read praecipe dated 14.01.2025 along with true copy of the provisional cause of death certificate cum death certificate No. 4779, issued by medical officer of Navi Mumbai Municipal Corporation. It is submitted that one of the legal heirs namely Avtar Khushal Singh Saini has expired on 28.02.2024 in road accident. In view of the said document, submission is accepted. Praecipe is allowed. Upon production of the death certificate of Avtar Khushal Singh Saini, re-verification is dispensed with, Ld. Advocate for the Petitioner to initial the amendment. 2.

Petitioner is permitted to delete the name of the Avtar Singh Saine within three weeks from the date of uploading of this order, if petition is pending. Amended petition to be uploaded within three days from the date of carrying out the amendment.

Petitioner to ensure that provision of Rule 383 of the Bombay High Court (O.S.) Rules, 1980 (Said Rules) are complied with in respect of additions in the will as per the Note given below Form No.102 of the Rules, otherwise take steps in this regard.

Furthermore, the petitioner to ensure that the citations have been served to the non-consenting legal heirs and beneficiary under the Will, as per the Rules. 5.

Petitioner to ensure that Administration Bond is filed for the gross amount and requisition of issuance of notice to collector is complied with, as per the Rules. 6.
