TP/2104/2024 (E-filing) Ms. Vaishali Sharma i/b. Harakhchand & Co., Advocate for petitioners PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Deepak Hirji Chheda and Harsh Bharat Chheda being Executors named under the Will of deceased. The deceased namely Panbai Hirji Chheda died at Mumbai on 10.08.2019. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copies of Aadhaar Card and Pancard are annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 12.04.2016. The said Will is in Gujarati language and translation of the said Will of the Chief Translator, High Court, Bombay is filed separately through e-filing on 21.01.2025. The Para No. 5 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will who are petitioners herein.

3. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. Deceased had two sons and two daughters. One son of deceased namely Bharat died on 26.08.2020 leaving behind his widow and one son. Deceased was survived by one son and two daughters, one daughter-in-law and one grandson. Out of them son and grandson are petitioners herein and both the daughters and daughter-in-law have given their consents in favour of the petitioners. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavits of Dr. Afshan Laheji and Khalid Laheji dated 01.06.2022 and Ami Hatish Gathani dated 31.05.2022 all the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 03.06.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
