Heard Ld. Advocate for petitioner. Ld. Advocate for petitioner to comply with the requisitions raised are as under :

1) To check prayer clause.

2) In the Consent Affidavit, there is no averment of justifying surety.

3) As per Will, there are beneficiaries which also in terms of conditions. Ld. Advocate for petitioner to file consent Affidavits of said beneficiaries.

4) As per Will, petitioner seems to be sole legatee.

5) To check the capacity of petitioner.

6) To comply with the directions mentioned in para No.8 of the Will.

7) To comply with the Rules 383 and 419 of the Bombay High Court (Original Side) Rules, 1980. At the request of Ld. Advocate for petitioner, matter is adjourned till 22.10.2024 for compliance of aforesaid requisitions.
