By an amendment petitioner had added deceased no. 2 namely Asha Ganghadhar Jog. Petition is presented for the grant of Letters of Administration for in respect of the properties left by the the deceased no. 1 and 2.

Now, Petitioner to point out that how petition is maintainable in respect of Asha Jog (deceased No.2), as deceased No. 2 has not left any property, which required to be administered.

3. Ld. Advocate for the Petitioner submitted that deceased was survived by his mother and widow. Mother died in the year 2019. Therefore, petition is maintainable as petitioner is claiming his right as a heir through the mother of the deceased as per the Section 15 (1) (a) of the Hindu Succession Act, 1956.

However, the chain of inheritance is to be shown as per the Rule 389 of the Bombay High Court ( O. S.) Rules, 1980 r/w Section 8, 9 and 15 of the Hindu Succession Act, 1956. Hence, adjourned for compliance.
