TP/2206/2024 (E-filing) Ms. Jyoti Badgujar i/b. S. U. Lakdwala, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. In the order dated 04.02.2025, the Hon'ble Court (Coram : Arif S. Doctor, J.) has recorded that the Registry has raised requisition that to justify surety of non-consenting legal heirs and to furnish Administration Bond. In view of this requisition raised, the petitioner filed an Affidavit dated 07.08.2024 and filed undertaking that petitioner undertakes to indemnify the Hon'ble Court, in the event, the party sustaining the prejudice by the grant of Succession Certificate, the petitioner undertakes not to dispose or create and third party rights for the share of nonconsenting legal heirs and requested for dispensing the above requisition in respect of justifying security. Accordingly, the Hon'ble Court accepted the said undertaking and requisition was dispensed with.
2. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioners namely Ranbir Kaur Kohli w/o. Manmohan Singh Kohli and Amarjit Singh s/o. Harbhajan Kaur Singh both being granddaughter and grandson of deceased respectively. Deceased namely Sahib Kaur w/o. Sardar Budh Singh alias Sahib Kour said to be died intestate at Amritsar, Punjab on 30.04.1985. Copy of death certificate is annexed to the petition as Exhibit - "A". Ld. Advocate for petitioner filed Affidavit of petitioner dated 22.03.2025 for dispensation of Identification proof of deceased which is annexed to the petition as Exhibit - "B".
3. Ld. Advocate for petitioner submits that parents of deceased and parents of husband of deceased predeceased the deceased. Husband of deceased predeceased the deceased. Deceased left behind her one only son. Son of deceased namely Phulel Singh died and his wife namely Harbhajan Kaur Singh also predeceased the deceased. They both died leaving behind three daughters and three sons. Thus, the deceased was survived by three married granddaughters and three grandsons. Out of them one married granddaughter and one grandson are petitioners herein. Justification of surety of nonconsenting legal heirs of deceased namely Anandpreet Singh has been dispensed with and all other legal heirs have given their consents. .......2
SLG - 2 - Consent Affidavits are on record. There are no other legal heirs.
4. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 27.01.2025 and Administration Bond dated 24.06.2024 are filed. All other legal formalities are complied with. Hence, petition is granted.
