TP/2388/2024 (E-filing) Ms. Alvina Godwin i/b. Bharucha Partners, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Rukhshana Sheriar Irani being Executor named under the Will of deceased. The deceased namely Sheriar Phirojshaw Irani died at Mumbai on 01.09.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 03.02.2023. The said Will is in English language.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by wife, one son and one daughter. Out of them wife is petitioner herein and all other legal heirs have given their consents in favour of the petitioner. Daughter of deceased namely Natasha Irani Haque has given Power of Attorney to her brother and he has filed consent on behalf of Natasha Irani Haque. Consent Affidavits are on record. There are no other legal heirs. As grandson of deceased namely Vivaan Irani is beneficiary under the Will who is minor also filed consent Affidavit through his mother and natural guardian namely Priyanka P. Shah Irani dated 02.09.2024.

4. Petitioner's oath is filed. Affidavit of Sridhi Menon and Anshul Singh dated 14.06.2023 both the the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 24.05.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
