TP/2434/2024 (E-filing) Ms. Swapna Raut a/w. Manish Kajale, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Amarjit Kaur Lotay being daughter of deceased. Deceased namely Sarwan Singh Amarsingh Lotay died intestate at Mumbai on 15.12.2021. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is already annexed to the petition.

2. Ld. Advocate for petitioner submits that parents and widow of deceased predeceased the deceased. Son of deceased namely Harjinder Sarwan Singh Lotay died leaving behind his widow and one daughter. Deceased was survived by daughter, granddaughter and daughter-in-law. Out of them daughter is petitioner herein and granddaughter name Harmeet Kaur Lotay has given her consent in favour of petitioner herein. Consent Affidavit is on record. Non-consenting legal heir of deceased daughter-in-law namely Jasvinder Kaur has been served with the citation through the office of Sheriff, Mumbai and Affidavit of Service dated 05.01.2026 is filed to that effect. There are no other legal heirs. Petitioner claims 50% shares from the securities of deceased mentioned at Schedule annexed to the petition. However, petitioner is required to justify 1⁄4th share of non-consenting legal heir of deceased namely Jasvinder Kaur by depositing the same with the office of Prothonotary and Senior Master. The valuation of Schedule I annexed to the petition is Rs. 33,11,768.64.

Petitioner has now deposited the amount of Rs.8,27,943/- in the office of the Prothonotary and Senior Master by demand draft No. 500065 dated 02.04.2026 of ICICI Bank, as per the receipt dated 07.04.2026 issued by Section Officer, Cash Section of the office of the Prothonotary and Senior Master annexed to the praecipe dated 10.04.2026.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 30.08.2024 and Administration Bond dated 04.09.2024 are filed. All other legal formalities are complied with. Hence, petition is granted.

4. Office to issue Succession Certificate as prayed upon confirming with the Cash section as regards the said deposit and after verifying whether any cross petition is filed or whether any Affidavit opposing grant is filed. 16.04.2026 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
