1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioners namely Leena Shailesh Shah being daughter of both the deceased and Vijaykumar Rasiklal Shah being son of deceased No. 3. Deceased No. 1 namely Manglaben Nagardas Shah died intestate at Mumbai on 23.05.1998. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Election Card is already annexed to the petition. Deceased No. 2 namely Nagardas Maganlal Shah died intestate at Mumbai on 05.07.1998. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 26.07.2025 for non-availability of identification proof of deceased which is already annexed to the petition. The same is accepted. Deceased No. 3 namely Hansaben Rasiklal Shah died intestate at Surat, Gujarat on 05.03.2002. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is already annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased Nos. 1 and 2 were husband and wife and they had three daughters and one son. Son of deceased namely Dinesh, died as bachelor. Deceased Nos. 1 and 2 were survived by three daughters. Out of them one daughter is petitioner herein and remaining two daughters have given their consents in favour of petitioner herein. Consent Affidavits are on record.

Husband of deceased No. 3 died on 16.02.2000 as per Exhibit - "F" annexed to the petition and she was survived by one son namely Vijay Kumar Rasiklal Shah who is petitioner No. 2 herein. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 10.11.2025 and Administration Bond dated 20.11.2025 are filed. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted.

4. Office to issue Succession Certificate as prayed after verifying whether any cross petition is filed or whether any Affidavit opposing grant is filed. 16.02.2026 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
