TP/2486/2024 (E-filing) Ms. Sharvari Nagvekar, Advocate for petitioner P.C.: 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Mahesh Ramchandra Devgharkar being sole Executor named under the Will of deceased. The deceased namely Bhagwan Sitaram Paradkar died at Mumbai on 27.06.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 20.11.2010. The said Will is in Marathi language and official translation of the same is filed through e-filing. The Page No.2 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will.

3. Ld. Advocate for petitioner submits that petitioner has filed Additional Affidavit dated 22.01.2025 stating that in paragraph No. 3 that deceased died as bachelor and parents of deceased predeceased the deceased. Deceased was survived by one brother whose whereabouts are not known and therefore, petitioner has served the citation through newspaper publication and Affidavit dated 30.10.2024 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Pravin Suryakant Mayekar dated 30.12.2023 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 27.06.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
