P.C.:

1. Perused Petition which is filed online. Heard Ld. Advocate for the Petitioner. This Petition is for Probate of Last Joint Will and Testament of the deceased filed by the Petitioner Sharathchandra Gopalakrishnan son of Ramiah Gopalakrishnan, being the Sole Executor named under the Will of the deceased. Deceased No. 1 - Vasanthi Krishnan aka Vasanthi Ramamurthy, said to have died at Texas on 07.10.2019 and Deceased No. 2 - Ramiah Gopala Krishnan said to have died at Pittsburgh on 09.03.2021. Copy of death certificate is annexed to the Petition. For identification proof of both the deceased, copy of Passport are annexed to the Petition.

2. Ms. Sanghavi Advocate for the Petitioner submits that deceased left behind their last Joint Will and Testament which was duly executed at Chennai on 17.12.2005. The said Will is in English language.

3. Ms. Sanghavi, Advocate for the Petitioner submits that deceased was governed under the Hindu Succession Act 1956. It is submitted that the parents of the deceased predeceased the deceased. Save and except as mentioned in para - 9, there are no other legal heirs left by the deceased. The Ld. Advocate for the Petitioner submits that the Petitioner being lay man was not aware of the provisions of law

) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) regarding filing of the Petition. Therefore, there is delay of about more than two year in filing this Petition. The Petitioner prays that the aforesaid delay in filing this Petition be condoned by this Hon'ble Court. Thus, the delay is explained.

4. Petitioner's Oath is filed. Consent Affidavits of two sons of the deceased as mentioned in para - 9 are on record. Affidavits of T. Prem Kumar and V. Pitchammal, both the attesting witnesses to the Joint Will are filed. Affidavit of service of General Citation is filed. All the Affidavits are also filed online. All other legal formalities are complied with. Hence, Petition is granted.

5. Office to issue Probate as prayed after verifying whether any Cross Petition or Caveat is filed.
