1. Ld. Advocate for the petitioner submits that Prakash is died in year 2016, i.e. he is pre-deceased to the deceased. Therefore, other legal heirs i.e. brother and sisters, who comes under category of Class-II, Entry-(II) of the schedule annexed to the Hindu Succession Act, 1956(for short HS Act") have preferential right than the legal heirs falling in Class-II, Entry-(IV) of the said schedule.

2. Therefore, petitioner to correct or amend the information about the legal heir in paragraph No. 4 of the petition, as per the provisions of Hindu succession act, particularly as per the section 9 and take steps accordingly.
