1. Ld. Advocate for Petitioner states that Petitioner is ready and willing to deposit amount, which is required to be paid to Vithabai Vitthal Nakhwa being the one of the legal representative of sole legatee under the the Will. Hence, the petitioner is willing to deposit the said amount with the office of the Prothonotary and Senior Master. Furthermore, Ld. advocate for the petitioner by this praecipe informed that names of the Vithabai Vitthal Nakhwa.

Petitioner is permitted to deposit a sum of Rs.20,00,000/-, to comply with the requisition raised by the office to justify the share of Vithabai Vitthal Nakhwa being of the non-consenting legal representative of the sole legatee under the Will vide Rule 422 of the Bombay High Court ( O. S.) Rules, 1980, on or before next appointed date with the office of the Prothonotary and Senior Master. Upon depositing the same, office of the Prothonotary and Senior Master may pass necessary directions regarding the investment of the above sum of Rs.20,00,000/-.

Upon deposition of said amount, further necessary endorsement may be made in the proceeding and upon proof of despist of the said amount requisition to justify the share stands dispensed with. 4.
