While perusal of the petition and will annexed to it and the affidavit of attesting witness it has been observed that in para no. 2 of the affidavit of attesting witness it is stated that "I was present together with Mr. Chandrakant Jadhav at the house of the deceased and we did then and there see the said deceased put her left hand thumb impression and signature in English language as well as vernacular Gujrati language at foot of the testamentary paper, which is referred to in the petition herein and marked as Exhibit "B" and declare and publish the same as her last Will and Testament.".

But it has been observed that there is no thumb impression of the testatrix on the Will. Advocate for the petitioner will verify the affidavit of attesting witness as well as seek instruction from the petitioner. List the matter on 27.02.2025.
