1. As per earlier order dated 11.02.2026, department has issued the notice to the petitioners and Ld. Advocate for the petitioners. However, none of them have appeared. Furthermore, notices are returned unserved with report of incharge of Sheriff's Office.

2. Department to re-issue the notices to the petitioners as per earlier order. Department to ensure that notices are issued today itself without any defect and as per the law.

3. Ld. Advocate for the Caveator is present along with the Caveator. Ld. Advocate for the Caveator submits that petitioners are misusing the grant and asking the society to delete the name of the caveator.

4. It appears that due to incorrect grant, petitioners are taking its undue advantage and therefore, Ld. Advocate for the Caveator may use the order copy of the Hon'ble High Court passed on 17.09.2026 and 20.09.2025 in TP/2687/2024 with JOT(L)/37240/2024 with CTS(L)/38866/2024 WITH IA(L)/993/2025. Furthermore, order of undersigned officer is as per said directions and department was directed that grant is to be issued in the name of the petitioner as well as in the name of the Caveator, namely Ulhas Madhukar Borkar.

5. Considering this submission, department is directed to prepare the correct grant as per the order of the Hon'ble Court and necessary endorsement may be taken that earlier grant issued only in favour of the petitioners is defective. All this exercise shall be carried out as early as possible.

6. In case of none submission of original grant, issued on 29.11.2025 by the petitioners, then in such circumstances matter will be placed before Hon'ble Court for taking necessary action against the persons who are not submitting incorrect grant and misusing it, according to the law for breach of directions.
