1. Ld. Advocate for the Caveator and petitioner are present. Ld. Advocate for the Caveator submits that there is delay in filing of the Caveat and he is prepared to file Interim Application as per the Rules. Ld. Advocate for the petitioner submits that he has filed Judges Order for justifying the share of nonconsenting legal heir. with JOT(L)/37240/2024 (AMH20230046647C202 400005)

2. Perused Judge's Order which is available in the drive. Coram and date of the order to be corrected, date mentioned before the Testamentary Judge is to be removed. Petitioners has to undertake to transfer the 1/5th share of non-consenting legal heir in the scheduled property within period of 12 weeks from the date of receipt of the Grant and deposit the said deed with the Office of the Prothonotary and Senior Master, High Court, Bombay or to take steps to deposit the equivalent amount to the share of the said Heir with the office of Prothonotary and Senior Master, High Court, Bomaby. Petitioner to comply with the above objections.
