Ld. Advocate for the Petitioner submitted that Suit having 302/2022 ((L)3082/2020) has been filed against Co-operative society and Ors., where flat is situated. He further submitted that he has taken out the Interim Application (L) No. 3084/2020 in which Hon'ble Court passed an order on 14.09.2020 in para no. 02, the Hon'ble Court was pleased to direct the Defendant no. 2 that the defendant no. 1 shall not enter the name of the Defendant no. 2 in society record as a co-owner until the Will propounded by the Defendant no. 2 is probated. He further pointed out that the petition filed by Defendant no. 2 having TP(L)9486/2020 on 19.12.2020 is dismissed under Rule 986 of the Bombay High Court (O. S.) Rules, 1980.
