By way of the present interim application, the applicant seeks the following reliefs :
"(a) For an order and direction exempting the Petitioner to take steps for the inventory of Safe Deposit Locker as directed by the Ld. Officer on Special Duty with Testamentary Department by its order dated 2nd July 2024;
(b) That the Applicant be permitted to carry out amendment to the Schedule-1 to the testamentary petition as per the Schedule of Amendment annexed hereto, on such terms as Hon'ble Court may deem fit;" The Learned Counsel for the applicant submits that the petition is for letters of administration to the properties and the credits of the one Narenddrakumar S. Kharkar (deceased). The Petitioner is the sole legal heir and beneficiary of the deceased. The Learned Counsel has then invited my attention to a communication dated 7 th October 2024, by which the branch manager of the Meera Jadhav
2/2 52-tp-2948-24.doc Saraswat Bank, in which the deceased held an account, has confirmed the opening of the said bank locker as also the context of the same. It is in these circumstances that the aforesaid dispensation has been sought for. After having heard the learned counsel, I am satisfied that on the basis of the averments made in the interim application as also the communication dated th October 2024, the Interim application is allowed in the above terms and is accordingly disposed of.
