Perused Petition. Heard Ld. Advocate for petitioner. Upon perusal of the petition, it is noticed that petitioner is sole Executor who is neighbour and family friend of the deceased.

Pursuant to order dated 19.09.2024, Advocate for petitioner has filed Affidavit of petitioner explaining details of the legal heirs of deceased. In para No. 3 of the said Affidavit, it has been categorically stated that petitioner is not aware about the age, current address of one of the brothers of deceased namely Neil Ramchand Chandi and hence inserted the words "Not Known" in the age and address column respectively. It has also stated in para No. 4 of the said Affidavit that petitioner got knowledge of the fact that the said Neil Ramchand Chandi expired as bachelor and he immediately informed his Advocate on 16.09.2024 through e-mail.

It is also stated in the said Affidavit that the death certificate of Neil Ramchand Chandi, is not available with the petitioner.

In the aforesaid circumstances, since whereabouts of the legal heirs of deceased not known, petitioner is required to serve upon the said legal heirs by way of

SLG ) ) ) ) ) ) ) ) ) ) ) ) ) publication and for that petitioner is required to take appropriate application to serve upon the legal heirs, if the legal heirs of said Neil Ramchand Chandi expired as per the statement of petitioner.

In view of the above, Advocate for petitioner is directed to take necessary steps with respect to the aforesaid objections.
