Advocate for petitioner submits that the present petition is converted from Letters of Administration with Will into Probate. Hence, citation yet to be issued after conversion.

2. In view of the aforesaid circumstances, Office to issue Citation within four weeks from the date of uploading of this order and also issue Notice to the Collector. Advocate is directed to take steps.

3. Advocate to file Affidavit of Service of General Citation within two weeks thereafter and also effect service upon non-consenting legal heirs, if any as per Rules 399 and 400 of the Bombay High Court (Original Side) Rules, 1980.

4 Office to verify if any cross petition is filed, if cross petition file, then take steps to place before the Hon'ble Court under Rule 407 of Bombay High Court (Original Side) Rules, 1980.
