TP/3168/2024 (E-filing) Mr. Yash R. Balle i/b. VJ Juris, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. Ld. Advocate for petitioner seeks leave to amend the para No. 5 and prayer clause of the petition with respect to the renouncing rights of another executor. Leave to amend is granted. Ld. Advocate for petitioner to carry out amendment within twelve weeks from the date of uploading of this order. Ld. Advocate for petitioner reupload the amended petition on the official portal of the Bombay High Court.

2. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Lalit Vijay Parashar being one of the Executors named under the Will of deceased. The deceased namely Vijay Kumar Parashar died at Mumbai on 18.03.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

3. The deceased left behind his last Will and Testament which was duly executed at Noida, Uttar Pradesh on 16.01.2021. The said Will is in English language. The Para No. 10 of the Will refers to the appointment of Executor. Only two Executor appointed under the Will. Petitioner is one of the executors and another Executor namely Deepak Parashar has renounced his rights to act as an Executor and Affidavit dated 20.04.2024 is filed to that effect.

4. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased was survived by two sons. Out of them one son is petitioner herein and another son has given his consent in favour of the petitioner. Consent Affidavit is on record. There are no other legal heirs.

5. Petitioner's oath is filed. Affidavit of Rohit Nagar dated 31.05.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 23.08.2024 is filed.

6. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant. Hence, remove from board. 18.07.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
