TP/3177/2024 (E-filing) Mr. Praful S. Pawar, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Chandrashekhar Vishram Shirodkar being sole Executor named under the Will of deceased. The deceased namely Shridhar Gajanan Korgaonkar died at Mumbai on 22.11.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Election Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 12.12.2012. The said Will is in Marathi language and translation of the same is annexed to the Affidavit of Advocate alongwith Affidavit of Advocate dated 13.02.2025 for certifying the said translation is true and correct translation of the Will. The Page No. 3 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased died issue-less. Deceased had three brothers and one sister. Sister of deceased died in the year 1951. Deceased was survived by three brothers who all have been served with the citation through the office of Sheriff, Mumbai and Affidavit of Service dated 23.07.2025 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Sanjay Anant Mervekar dated 11.03.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 05.02.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
