Petitioner to explain the legal heirs as per the provisions of the Sec. 15(1)(a) to (e) of the Hindu Succession Act, 1956.

The petitioner has filed the affidavit of Dattaprasad Ghotgiskar, as attesting witnesses, namely That the Attesting Witneses namely Shriniwas Vishnu Karnerkar and Chandrkant Ramchandra Parulekar, are no more. Their death certificates are produced vide praecipe dated 09.12.2024.

Hence, as per the direction of the Hon'ble Court in Testamentary Petition in case of Ramprakash Shreekishindas Aggarwal Vs.

Nandlal Ramprakash Aggarwal and another in Petition No.50 of 2011, the petitioner to ensure that necessary averment is made in the petition, about the acceptance of the affidavit in compliance of Rule 384 of the Bombay High Court (OS) Rules, 1980.

Furthermore, the petitioner to ensure that the compliance of Rule 383 of the BHC Rules is complied with.
