TP/3228/2024 (E-filing) Ms. Shobhana Waghmare, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Jyoti Dnyaneshwar Ghuge and Dnyaneshwar Kachru Ghuge being Executors named under the Will of deceased. Deceased namely Munnilal Supai Yadav said to have died at Uttar Pradesh on 15.09.2016. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind his last Will and Testament which was duly executed at Mumbai on 28.03.2016. The said Will is in English language.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Wife of deceased died on 23.09.2023. Deceased had no daughter and was survived by four sons. All four sons have been served the citation through Bailiff from the office of Sheriff and Affidavit of Service of citation dated 19.11.2024 filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Ganesh M. Kotian dated 21.05.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 29.11.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
