TP/3287/2024 (E-filing) Mr. C M Lokesh, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Arun Hindurao Sawant being sole Executor named under the Will of deceased. The deceased namely Shrirang Chokhu Gaikwad died at Mumbai on 21.07.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 10.11.2020. The said Will is in Marathi language and official translation is annexed to the petition. The Para No. 4 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. One son of deceased namely Mahendra Shrirang Gaikwad died leaving behind his widow and one son. Deceased was survived by three sons, one daughter, one daughter-in-law and one grandson who all have given their consents in favour of the petitioner. The Consent Affidavit of Sandhya Mahendra Gaikwad dated 01.10.2025 on behalf of her minor son namely Akshay is filed. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Ashok Dasharath Shinde dated 14.02.2024 one of the Attesting Witness to the Will is not filed. Affidavit of Service of General Citation dated 04.09.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
