TP/3329/2025 (E-filing) Mr. Vikas Nana Tambavekar a/w. Sandhya S. Mhaskar, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Venkateshprasad Narayan Iyer being one of the Executors named under the Will of deceased. The deceased namely Narayan Lakshman Ayyar died at Mumbai on 05.06.2005. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Election Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 15.11.2004. The said Will is in English language. The Para No. 3 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will. Petitioner is one of the executors and another executor namely Gowri has reserved her rights to act as an Executor and as per para No. 3 of the Affidavit dated 15.11.2024. Prayer clause of the petition is incorrect hence, Advocate to take steps accordingly.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased was survived by one son and one daughter. Out of them son is petitioner herein and the daughter has given her consent in favour of the petitioner. Consent Affidavit is on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Dr. Rajesh Rasiklal Parikh dated 15.11.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 25.07.2025 is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant.
