TP/3336/2024 (E-filing) Mr. V. K. Rajbhar, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Leena Prakash Grounder being one of the Executrix named under the Will of deceased. The deceased namely Tarabai Shriniwash Nayakar died at Mumbai on 01.10.2021. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 28.12.2015. The said Will is in English language. The Para No. 4 of the Will refers to the appointment of Executors. Only four Executors appointed under the Will. Petitioner is one of the executrix and remaining three executors namely Sarla Bhaskaran, Renukadevi Lognathan and Subhalaxmi Mudliar have reserved their rights to act as an executors and Affidavit dated 22.07.2025 is filed to that effect. Ld. Advocate for Petitioner seeks leave to correct the prayer clause of the petition. The said corrections are allowed. Ld. Advocate for petitioner to carry out corrections within twelve weeks from the date of uploading of this order. Ld. Advocate for petitioner to re-upload the corrected petition on the official portal of the Bombay High Court.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Deceased was survived by four daughters. Out of them one daughter is petitioner herein and remaining three daughters have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Hiten Arvind Gohil dated 03.01.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 16.08.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
