TP/3377/2024 (E-filing) Mr. Jayant Wani i/b. Rajesh Narang, Advocate for petitioners PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain debts belonging to deceased filed by petitioners namely Sunil Ghansham Hemdev and Jiten G. Hemdev being sons of deceased. Deceased namely Ghansham Hassanand Hemdev died intestate at Mumbai on 15.03.2020. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is already annexed to the petition.

2. Ld. Advocate for petitioner submits that mother of deceased predeceased the deceased. Widow of deceased since deceased the deceased who died on 15.11.2023. One daughter of deceased namely Sunita died leaving behind one son namely Tarun Chandani. Deceased was survived by two sons and one grandson. Out of them both sons are petitioners herein and the grandson has been served with the citation and Affidavit of Service dated 03.10.2024 is filed to that effect. Justification of surety of non-consenting legal heirs i.e. grandson has been dispensed with as per order dated 10.10.2025 in Interim Application No. 2708 of 2025. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 03.10.2024 and Administration Bond dated 23.10.2024 are filed. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted.
