TP/3444/2024 (E-filing) Mr. Hemant Hasnale i/b. Aishwarya Shinde, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Pamela Vishwanath being sole Executor named under the Will of deceased. The deceased namely Laxmi D. S. Venkatraman died at Palghar on 15.10.2018. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 30.05.2015. The said Will is in English language. The 1st line of page No. 2 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein. Residuary clause in respect of properties of deceased is mentioned at last para of 1st page of the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased died as spinster. Deceased had one brother namely Venkatraman Vishwanath who died leaving behind his widow and one daughter. Deceased was survived by one sister-in-law and one niece. Out of them sister-inlaw is petitioner herein and the niece has given her consent in favour of the petitioner. Consent Affidavit is on record. There are no other legal heirs.

4. Petitioner's oath is filed. Petitioner has filed Affidavit dated 13.11.2025 stating therein that both the Attesting Witnesses to the Will not known to the petitioner. Therefore, petitioner has filed Affidavit of Yohann Hoshang Banajji dated 13.02.2024 as an Affidavit in compliance of provision of Rule 384 of the Bombay High Court (Original Side) Rules, 1980. The same is accepted. Affidavit of Service of General Citation dated 18.09.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
