1. Ld. Advocate for the Petitioner made available of the family tree of the deceased. I have gone through the same. Petitioner died unmarried leaving behind her sister Surekha, who is entitled to claim the inheritance being the Class-II, entry-II legal heirs as per the provisions of the Hindu Succession Act, 1956. Hence, in the life time of Class-II, entry-II legal heirs, agnate of the deceased will not have a right to inherit the property as per the Section 08 to 13 of the Hindu Succession Act, 1956. Hence, the petitioner to satisfy about his capacity to present the petition.
