TP/3482/2024 (E-filing) Mr. Pawankumar Tiwari, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Sandeep Sood being sole Executor named under the Will of deceased. The deceased namely Prem Lata Sood died at Mumbai on 28.01.2021. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 02.06.2014. The said Will is in English language. The last Para of the Will refers to the appointment of Executor. Only one Executor appointed under the Will.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Deceased was survived by her three sons and two daughters who all have given their consents in favour of the petitioner herein. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Dindayal Arora dated 05.01.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 21.08.2024 is filed.

5. Upon perusal of the petition, it is noticed that the Will is in English language and deceased had signed in Hind language however, the Affidavit of Attesting Witness does not states that whether Will was explained or interpreted to the deceased or not. Ld. Advocate for petitioner file praecipe to place on board as ad when all compliance is done in this matter. Remove from board.
