Petitioner to verify the capacity, as he is not legatee under the Will, as the property is bequeathed the Vimal who survived the deceased. Hence, petitioner to take steps to correct his capacity, as per the provisions of the Indian Succession Act, 1925.

Ld. advocate for the petitioner moved a praecipe dated 25.02.2025 and thereby seeks permission to amend the petition by mentioning that the petitioner is one of the representatives of the Said Vimal and thus he presented a petition. Submission is accepted and praecipe is allowed upon condition that the petitioner shall make necessary and detail averment in respective paragraph of the petition and the petitioner shall also give details of the persons, who are, in law, are the representatives of the said Vimal, as per the Provisions of the Hindu Succession Act, 1956.
