1. Perused Petition. Heard Ld. Advocate for petitioner. Ld. Advocate for petitioner seeks leave to amend the Schedule as regards the HUF property. Amendment is allowed. Ld. Advocate for petitioner to carry out amendment within twelve weeks from the date of uploading of this order. Ld. Advocate for petitioner to re-upload the amended petition on the official portal of the Bombay High Court.

2. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Amrish Rajnikant Nilachand being sole Executor named under the Will of deceased. The deceased namely Ramila Rajnikant Kilachand died at Mumbai on 18.02.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

3. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 19.08.2017. The said Will is in English language. The Para No. 6 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein. Residuary clause in respect of properties of deceased is mentioned at para No. 15 of the Will.

4. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. Deceased was survived by two sons. Out of them one son is petitioner herein and another son of deceased namely Harsh Rajnikant Kilachand has filed Caveat being CTSL No. 30974 of 2024 and the same has been rejected under Rule 986 of the Bombay High Court (Original Side) Rule, 1980 by an order dated 12.06.2025. There are no other legal heirs.

5. Petitioner's oath is filed. Affidavit of Ravishankar Kashinath Dubey dated 30.03.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 08.10.2024 is filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted. .....2

6. Office to issue Probate as prayed subject to disposal of IA No. 3294 of 2025 (for dismissal of Caveat) and uploading of the amended petition as well as corrected Schedule for Notice to Collector on the official portal of the Bombay High Court and after verifying whether any cross petition is filed or whether any caveat is filed.
